Terms of service

This is an English translation. In case of any difference, the Hungarian version prevails.
CloneSync (the service) is a Discord bot and website that copies the content of a Discord server to another (backup) server and keeps it in sync live. The operator of the service: the operator of CloneSync, reachable on the Support page. By using the service you accept these terms.
1. Who can use it
- Anyone who has reached the age needed to use Discord, and accepts Discord's Terms of Service and Community Guidelines.
- Only someone who is an Administrator on both the original and the backup server can start a backup.
2. Your responsibility
- You may only back up a server whose content you are entitled to copy, and you have to inform the server's members that a backup of the server is made.
- Whoever set up the backup is responsible for the backup server's content and for who has access to it.
- It is forbidden to use the service to copy others' content without permission, for harassment, spam, to get around Discord's rules, or to overload the service.
3. Plans and payment
- The content and price of the plans are on the Pricing page. The prices are monthly fees and do not include VAT; the VAT is on the invoice.
- The subscription belongs to the user account and is valid until it ends. After it ends, the Free plan's rules apply; backups are not deleted, but keep running within the Free limits.
- We notify you in a Discord message 7 and 1 days before it ends, and when it ends.
- If the service does not work for a longer time through the operator's fault, we may extend the subscriptions by the time lost.
- Withdrawal and refunds: under the consumer protection laws. We receive your request at the contact above.
4. How the service works
- We run the service with the greatest possible care, but provide it "as is": we cannot guarantee continuous, error-free operation.
- Because of Discord's limits (file size, rate limits, permissions) there may be delays, or an item may not be copied. The exact limits are on the Features page.
- The backup is on Discord: if Discord deletes the server or makes it unavailable, we cannot take responsibility for that.
5. Server snapshots, images, videos and files
The Snapshots service records the state of a Discord server at a given time on the user's request, and makes it possible to restore it to a server chosen by the user. By using the service the user acknowledges and accepts the following:
- How attachments are stored. CloneSync does not copy or store the images, videos and other files attached to messages (attachments). Of the attachments, the snapshot contains only the file's name, size, type and the link to the copy stored on Discord's servers. The attachment stays on Discord's servers; its keeping, availability and deletion are governed by Discord's rules in force at the time.
- Automatic snapshots and deleting old ones. After a server's first snapshot, CloneSync makes new snapshots of the server automatically as often as the subscribed plan says, while the user has a snapshot of it, the plan allows it, CloneSync is on the server and the user is an Administrator there. After a new snapshot is ready, only the plan's number of newest snapshots of the server are kept; older ones are deleted automatically and for good. The automatic snapshots can be stopped by the user deleting all snapshots of the server. The numbers (servers, interval, snapshots kept) are in the plans' description; they may change.
- Restoring. When restoring, CloneSync requests the attachment from Discord by its link and uploads it again. An attachment can only be restored if it is still available on Discord at the time of the restore.
- Keeping is not guaranteed. An attachment is lost for good and beyond recovery if the original message, channel or server is deleted, if Discord removes the file or makes it unavailable, or if Discord changes how links or files are served. In that case the restored message shows this in the attachment's place.
- Items stored in the snapshot. The server's icon, the emojis, stickers and avatars are stored on CloneSync's storage as part of the snapshot if the whole snapshot stays under 20 MB; in a larger snapshot only their link on Discord is kept, and the rules above for attachments apply to them. The rest of the snapshot (settings, roles, channels, the text of messages) is always stored on CloneSync's storage.
- Exclusion of liability. To the fullest extent permitted by law, the operator excludes liability for the loss, damage or unavailability of attachments and snapshots, and for an incomplete or failed restore, including in particular deletion, restriction or modification by Discord, the suspension or end of the service, deletion of the snapshot by the user, or the end of the subscription.
- Your own backup. The Snapshots service is not an archiving or data retention service, and does not replace your own, independent backup of important images, videos and files; making that is the user's responsibility.
- Ending. If the service ends or the account is deleted, the snapshots are deleted and cannot be restored later.
6. Suspension, termination
- If the terms are violated, we may stop the backup and restrict access.
- You can stop using the service at any time: stop the backup, and kick the bot from the server.
7. Liability
To the extent permitted by law, we are not liable for indirect damage, lost profit or data loss arising from using the service or from its outage. This does not affect the rights consumers are entitled to by law.
8. Changes, governing law
We may change the terms; we announce important changes on the website. The terms are governed by Hungarian law. Data handling is described on the Privacy page.
